European Patent Extension

For extension of European Patents to Romania and assuming that Romania was designated at EPO and the corresponding fees are paid there are two alternatives:

1. Application for Provisional Protection of the European Patent
Application is to be filed within 3 months as from the publication date of the European Patent Application (EP....A1).

A published European Patent Application will confer a provisional protection as from the date of publication by Romanian Patent Office of the translation into Romanian language of the European Patent Application claims. The Romanian translation must be filed at the Romanian Patent Office and is published as soon as the Official Fees (US$ 60) are paid.

FILING REQUIREMENTS:
- Publication of the European Patent Application (EP.....A1);
- Power of Attorney;
- Romanian translation of the claims;

2. Application for extension of the European Patent
Application will be filed within 3 months as from the date of publication of the mention of grant (EP....B1).

An extended European Patent will confer the same rights as a National Patent as from the date of publication by EPO of its mention of grant.

The owner of the European Patent will file at the Romanian Patent Office the Romanian translation of the specification of the extended European Patent and will pay the Official Fees.

FILING REQUIREMENTS:
- Publication of the European Patent specification (EP....B1);
- Power of Attorney;
- Romanian translation of the disclosure , abstract and claims;
- Drawings, if any.

Annuities will be paid for the years following to the year in which the mention of grant of the European Patent was published.
